What Is Initiative 71?

Initiative 71 (I-71) was passed by DC voters in November 2014 and took effect in February 2015. It legalized the possession and home cultivation of cannabis for adults 21 and older in Washington, DC — but it did not create a commercial retail sales market.

What I-71 Allows

  • Possession: Adults 21+ may possess up to 2 ounces of cannabis.
  • Home cultivation: You may grow up to 6 plants at your primary residence (no more than 3 mature at one time).
  • Gifting: Adults may transfer (gift) up to 1 ounce of cannabis to another adult 21+, as long as no money, goods, or services are exchanged for the cannabis itself.
  • Private consumption: Cannabis may be consumed in a private residence. You may not consume in public spaces, vehicles, or federal property.

What I-71 Does NOT Allow

  • No public consumption. Smoking or vaping cannabis in public is illegal and subject to fines.
  • No sales without a license. Selling cannabis without an ABCA license is a criminal offense.
  • No consumption on federal property. This includes the National Mall, federal buildings, and any property owned or leased by the federal government — which covers a significant portion of DC.
  • No consumption in vehicles, even parked.

The "Gifting" Model

Because Congress blocked DC from establishing a licensed retail sales market for years, a "gifting" economy emerged. Businesses sell a product or service (a t-shirt, a juice, an "experience") and "gift" cannabis alongside it.

Important: The ABCA has clarified that gifting transactions where cannabis is the clear primary value exchange may still be prosecuted. Always verify that any business you interact with holds a valid ABCA license.


ABCA: The Regulatory Authority

The Alcoholic Beverage and Cannabis Administration (ABCA) is the DC agency that licenses and regulates cannabis businesses. As of 2024, ABCA issues licenses for:

  • Medical Dispensaries — licensed to sell cannabis to registered medical patients
  • Cultivation Centers — licensed to grow cannabis
  • Testing Laboratories — licensed to test cannabis products
  • Retailers — adult-use retail licenses (rollout ongoing)
